Criminal Court Judge Barry Steelman on Monday lifted a no contact order between a man charged with criminal homicide and the main witness against him.

Attorney Lloyd Levitt said Kiana Varnell is the girlfriend of Cordarius Robinson, and they both want to resume seeing one another.

Prosecutor Lance Pope said he had concerns about the action, but he noted that Ms. Varnell had already given police a detailed statement about the shooting death of Timothy Harris on Nov.

1, 2015, and testified twice in court.

Harris was found lying in the street in the 1600 block of Olive Street suffering from multiple gunshot wounds and was pronounced dead by the medical staff at Erlanger after being transported there.

Ms. Varnell said Monday that she and Robinson got a call that Harris, her step-father, was harming her mother. She said they drove in a rental Jeep to their address.

She said Harris turned his anger on them, ramming the Jeep Wrangler repeatedly with his truck, and threatening to "---- you up."

She said Robinson then produced a gun and said, "I'm just going to shoot him."

She said she heard gunshots as she fled from the Jeep.

Witnesses said Robinson shot Harris multiple times as the victim started to walk away. Witnesses said Harris and Ms. Varnell then fled in the damaged black Jeep.

Attorney Levitt said Robinson has no prior criminal record and is holding down a job.

He is free on a bond that was raised from $50,000 to $150,000.

General Sessions Court Judge Gary Starnes set the original no contact order.

Robinson is due back in court on Feb. 1.
