Couple Whose Son Was Found At Bottom Of Baylor School Pool File $10 Million Lawsuit

A couple whose son was found at the bottom of the Baylor School pool and who later died have filed a $10 million lawsuit against the school.

Dr. Jerry and Robin Smith filed the Circuit Court suit in connection with the death of their 16-year-old son, Sumner Smith.

The suit says on Oct. 5, 2015, that the teen was participating in a required swim practice in the school's 12,000 plus-gallon pool when he was found lying on the bottom.

It says he was lying there for a significant period of time before being brought to the surface.

The suit says he was taken to the hospital by ambulance and attempts were made to revive him, but he died about six hours later.

The complaint says there were two swim teams practicing at the time, but only enough coaches for one swim team.

It says the pool did not possess the proper safety equipment, including lifeguard stands.

There were no lifeguards on duty at the time, the complaint says.

The Smiths are asking $5 million compensatory damages and $5 million punitive damages in the lawsuit filed by attorney Jeff Rufolo of Summers, Rufolo & Rodgers.
