Tower Company Sues Hamilton County In Federal Court Over Denial Of Cell Tower

A tower company has sued Hamilton County in Federal Court over the denial of a cell tower.

Vogue Tower Partners said the County Commission should have allowed the tower at Jennifer Lane that was opposed by a large number of neighbors.

The 20-page complaint, filed by attorney Hal North, says the tower was needed to remedy a significant coverage gap in that area.

It says the application satisfied all the requirements of the local regulations.

The suit says Verizon would be the main tenant on the tower, but it would be open to other carriers.

Residents said the site was too close to the Hurricane Creek subdivision.

Commissioner Sabrena Smedley, a realtor, said it would have lowered nearby property values.
