Time For Loser Pays - And Response

  • Thursday, February 6, 2014

If there was ever an example of why we need a "loser pays" system in our courts it is the Hennen trial that ended yesterday. This very well-respected family was forced to re-live a terrible tragedy that took the lives of two beautiful and intelligent young people due to the actions of a gold-digging mother and her sleazebag ambulance chasers.

And I might add the rest of the Barnes family had to go through the same, all because Lisa Barnes wanted to cash in on her own daughter's death. As the Hennen family's attorney said, this suit is, "cruel, wrong and only for the money." Evidently the jury agreed as they only took 90 minutes to rule in favor of the Hennens.

Every night watching TV we are constantly bombarded by the ambulance chasers and "slip and fall " attorneys' advertisements. There is no wonder we end up with lawsuits like these. If we go to a ,"loser pays" system it would cut down on these ridiculous suits that clog up our courts and delay justice for legitimate legal complaints.

One of the attorneys for Lisa Barnes has been publicly censured by the Judicial Review Board for accepting a settlement without the authorization of his client and endorsing the check. In my profession if I endorsed a check without a client's authorization not only would I lose my license but I would probably go to jail. I guess the laws that apply to us regular folks don't apply to ambulance chasers.

I agree with Doug Jones. The endless barrage of personal injury attorney commercials everytime the T.V. is turned on for a few moments is truly annoying. It seems there's no limit to the hype and sensationalism to get your "business."

The only other type of TV commercial that is more pathetic is the sex drug commercial.  Then again, aren't both trying to do the same thing to you?
