Hearing for Braylon Davis

A convenience store clerk who was robbed July 13 by a man who displayed a gun said the robber had just been in the store 30 minutes earlier.

The clerk said he told the robber, "I know you," then he was slugged in the face with the gun, knocking out his front left tooth.

A charge of aggravated robbery was bound to the Grand Jury against 21-year-old Braylon Glenwood Davis.

Davis was charged with theft over $10,000 two months earlier.

And last year he was charged with vehicle homicide after a wreck that killed the son of a winner of the Survivor reality show.

The clerk said he was in the back of the Kangaroo Express on East Brainerd Road stocking the cooler when he heard the front door open. He said he was then confronted by a man with a shirt pulled partially over his face and wearing a cap.

He said after he indicated he recognized the man, he was told, "C'mon, I'll shoot you. You think I'm playing?"

The clerk said he was then hit with the black gun, which he said he had looked down and noticed in the robber's waistband. He said it looked like a 357 Magnum revolver.

He said he then got some $200 in cash from the cash drawer. He said he counted it out slowly "because I wanted to get a good screen shot" from the video camera behind him.

He said he knew the robber and had earlier given him a music video. He said he had been to the duplex at the end of Hamlett Drive, where he was staying. Hamlett Drive is off East Brainerd Road.

He said he had seen the robber "multiple times" in the store and could identify Davis as the robber.

Dallas Harvey said Davis had been living at his residence - the duplex - for a couple of weeks, sleeping on the couch. He said he loaned Davis and two others his car earlier that night when they said they wanted to go to City Cafe.

He said one of those with Davis, Josh Robinson, asked to use his red Sentra early that morning. Detectives said the Sentra was used by the robber.

Harvey said Davis had told him he was in need of money because he had lost money gambling. He said after the incident that Davis showed him a wad of money.

Prosecutor Lance Pope said during the hearing that Harvey had not given the same story he told police and had just told him outside the courtroom about Davis admitting his involvement in the robbery. General Sessions Court Judge Clarence Shattuck had Harvey sit with inmates in the courtroom until after the hearing. Prosecutor Pope then told the judge he would not bring any charges against Harvey at this time.

Harvey told detectives there had been two guns at the residence that were really BB guns. He said one looked like a semi-automatic and the other like a revolver. Police found the semi-automatic, but not the revolver.

They found a shirt and cap matching the description of that worn by the revolver and they found a wad of cash in a bathroom vanity.
