Man Who Was Shot In The Leg Files Suit In Federal Court

A 52-year-old man who was shot in the leg by a county officer "while avoiding arrest" last Jan. 19 has filed suit in Federal Court.

Kenneth Charles Rogers is suing the county, Sheriff Jim Hammond, Deputy Nathan Fountain, Deputy Carl Young, Deputy Mike Mullins and the unknown deputy who shot him.

Attorney John Wolfe said Rogers almost died from the gunshot.

He said he has not been able to learn the name of the deputy who shot him, who said the county refuses to turn over a Use of Force report. He said another sheriff document says he "was shot by law enforcement."

The attorney said Rogers "was in no way a threat" to the deputies on the scene.

The suit says the bullet shattered his femur bone and the femoral artery near it, and he nearly bled to death. 

It says, "This sandbagging must end. Someone must publicly claim the bullet that caused serious injury to Kenneth Charles Rogers."

The suit asks $9.6 million in compensatory damages and $3.2 million in punitive damages.
