The Tennessee Occupational Safety and Health Administration (TOSHA) said it found no safety violations in the traffic death of Chattanooga Police Officer Nicholas Galinger on Hamill Road.
The report says Officer Galinger and another officer had responded to check out an overflowing manhole cover.
It says, "They determined there was not much they could do about the manhole cover and planned to report the incident to the Public Works Department."
The report says as they walked back to their vehicle Officer Galinger turned and went back to the manhole cover. He bent over alongside the manhole cover and examined it with his flashlight.
It was noted that a driver then came speeding along and struck the officer.
Janet Hinds, the former Soddy Daisy postmaster, has been charged with vehicular homicide and other counts.
The report concludes, "Given the facts of this case, no violations of the TOSHA standards were citable." The case file was closed.
