Judge Told Man Again Re-Entered U.S. Because Of Ill Son

An attorney in the Federal Public Defender's Office said a Guatemala man who had been deported before he came back to Chattanooga because his ill son can get medical treatment here.

Giana Maio said Andres Loarca-Reynosa's seven-year-old son has a serious respiratory ailment. "He is unable to get treatment for it in Guatemala."

She said, "He feels a compulsion to provide for his three children." Also, she said his wife is seriously ill and, without him, the family will have no support. 

In Guatemala, she said, "He has no place to stay - nothing."

The first time he was caught, Loarca-Reynosa spent eight months and 20 days in federal prison before being sent back to Guatemala.

He was arrested and given an ICE hold after he was involved in a recent traffic accident.

Judge Sandy Mattice ordered him this time to serve 11 months in prison.

Then it's back to Guatemala.
