Attorneys for Mark Hazelwood, the former Pilot Travel Centers president, are asking that he be given a bifurcated sentencing hearing.
Hazelwood is set for sentencing by Judge Curtis Collier at the Federal Courthouse in Chattanooga on Sept. 26 at 9 a.m.
He is facing a possible lengthy prison sentence after being convicted of several counts involving fraud against trucking companies, who were cheated out of millions of dollars of promised rebates.
Hazelwood's attorneys said there will be extensive argument concerning the presentence report. The attorneys said the government is seeking to enhance the sentence for Hazelwood by claiming that he was involved in fraud against 78 companies.
The petition says there is insufficient evidence of fraud involving many of those customers.
The motion asks that Judge Collier consider all the objections, then come back for the sentencing at least two weeks later.
