Man Given "Ride" In Port-O-Let Files Suit

  • Tuesday, March 19, 2002

A worker whose trip to the Port-O-Let was interrupted by a practical joke failed to see the humor.

Joshua Francis has filed a $200,000 lawsuit in Hamilton County Circuit Court in connection with the incident last March 19 on the lawn of the Marion County Courthouse.

Mr. Francis was working for Mountain City Sprinkler Corporation when he "took a break and was using a Port-O-Let. While he was using the Port-O-Let, an unknown employee of Masonry Specialist Corporation, operating a forklift, picked up the Port-O-Let, with Mr. Francis inside as a practical joke."

When the Port-O-Let was suspended in air by the forklift, the structure tipped and fell from the forklift, "crashing to the ground, causing injury and humilation to Mr. Francis."

The suit against Masonry Specialist Corporation said it failed to properly supervise its employees and provide a safe work environment.

Mr. Francis is seeking $100,000 in compensatory damages and $100,000 in punitive damages.

Attorney Joseph Warwick filed the complaint.
