Patent Appeals Board Rules Against Local Red Wolves Keeping Their Nickname

A federal patent appeals board has ruled against the Chattanooga Red Wolves pro soccer team's continued usage of their nickname.

Arkansas State - also the Red Wolves - had opposed the local team's efforts to get patent protection.

The 28-page ruling says, "We have considered all of the evidence pertaining to the relevant DuPont factors, as well as the parties’ arguments. In balancing the relevant factors, given the identical and closely related goods and services and trade channels, and the similarity of the marks, we find likely confusion."
