Family members of Robert L. Blaskoski say he has been missing since 1994 and should be declared dead.
The petition in Chancery Court would allow the payment of certain insurance policies and settlement of the estate.
Mr. Blaskoski was living at 1705 East Ridge Ave. when he disappeared at the end of July in 1994. His relatives said they called various employment and financial contacts, contacted Missing Persons and ran an ad in the newspaper.
The petition says Donald and Kerry Ford of East Ridge "are believed to have had the last contact with Mr. Blaskoski."
It says Mr. Blaskoski traveled in his job and had asked Mr. Ford, a maintenance worker at the apartment complex where both lived, to look after his unit and collect his mail.
It was claimed that Donald Ford "fraudulently and deceitfully withdrew $27,662 from two accounts Mr. Blaskoski held at Merrill Lynch and took $10,850 from his account at First Union Bank and $37,730 from his Tennessee Valley Federal Credit Union account.
The petition says settlement agreements have been reached for the return of $25,500 from Merrill Lynch, $25,000 from the TVFCU and $2,500 from First Union Bank.
Donald Ford plead guilty to charges of forgery and theft.
The petition says Noelle Blaskoski, daughter of Robert Blaskoski, was murdered in December 1996 at her apartment. The slaying remains unsolved, but the petition says Texas police "do not believe Noelle's death and the disappearance of Mr. Blaskoski are related."
The suit says, "It is the belief of the family, the East Ridge Police Department and the district attorney's office that Mr. Blaskoski was likely the victim of foul play."
Another daughter lives in Texas and a son is in Japan.
