Chancellor Upholds City On Hixson Publix Lawsuit

Chancellor Howell Peoples has ruled against four Hixson residents who sued over the planned new Publix grocery in Hixson.

After a trial that lasted two and a half days, the judge ruled that the decision to allow the project was not arbitrary and capricious.

The plantiffs said the project at the corner of Cassandra Smith Road was not in accordance with the Hixson Land Use Plan.

Publix earlier announced plans for several new stores in the Chattanooga area.
