Judge Collier Denies Hazelwood Motion To Be Allowed To Leave Home Confinement 3 Times A Week; Allows Him To Go To "Sealed" Court Hearing

Federal Judge Curtis Collier has denied a motion filed in behalf of former Pilot Travel Centers president Mark Hazelwood to be allowed to leave his home confinement for three times per week.

However, he did allow him to attend a "sealed" court session in Knoxville in which over nine people have given sealed depositions, according to a court filing. 

Hazelwood was sentenced to serve 12 and one-half years in prison for his leading part in a widespread fraud against multiple trucking companies.

He was allowed to remain at his home in Knoxville during an appeal of the case.

Judge Collier said in the order on the release three days a week, "Before the Court is a motion by Defendant Mark Hazelwood to modify the terms of his release to allow him to leave his home every Tuesday, Thursday, and Sunday for three hours each. (Doc. 876.) Defendant does not state the reason behind his need to leave home three days a week for three hours. Defendant includes a two-page list of times when he has been allowed to leave his home without incident. He states that the United States does not oppose his motion, and that he and his family have agreed to post certain properties as additional security for his bond. He does not state the position of his supervising pretrial services officer. Lacking a reason for the modification Defendant seeks, Defendant’s motion (Doc. 876) is denied."

The motion filed by attorney Bradley Henry concerning the sealed court hearing says, "Defendant, Mark Hazelwood, (“Mr. Hazelwood”) respectfully moves this Court to modify his conditions of release to permit him to attend a legal proceeding the week of June 24, 2019. As the government is aware, Mr. Hazelwood is a party to an ongoing sealed matter. This is the same matter that was the subject of two earlier motions, which the Court granted, allowing Mr. Hazelwood to attend two depositions in downtown Knoxville. (Doc. 869 and 871) (Although more than 9 persons have been deposed in this sealed matter, Mr. Hazelwood only asked to be allowed to attend those two depositions in person.) A hearing is scheduled to occur from June 24- 28, 2019. Mr. Hazelwood, as party to the matter, is required to attend, and the location has been set for downtown Knoxville."
