Judge Rules That Bob Perlaky Can Remain As Raccoon Mountain Caverns And Campground Manager, But Steve Perlaky Can Still Hire Outside Firm

Chancellor Jeff Atherton has put down a ruling that Bob Perlaky can remain as general manager of the Raccoon Mountain Caverns and Campground, but that his brother Dr. Steve Perlaky can still hire the RVC outside management group.

Bob Perlaky and another brother, Jeff Perlaky, sued Dr. Steve Perlaky after Dr. Perlaky went to the property on Oct. 31 and told Bob he was fired. Dr. Perlaky, who is the majority owner, testified that he has a number of questions about the handling of the finances at the Lookout Valley site.

Chancellor Atherton said both Bob Perlaky and Dr. Steve Perlaky would be signers on the attraction's bank account.

The judge said if RVC cannot enter into a management agreement with Dr. Perlaky without having their own manager in charge, "then they won't be entering into this business deal."

RVC said it reached an agreement with Dr. Perlaky on managing the Lookout Valley site, but has not been able to begin its work there.

It was noted that the management firm has already begun collecting money for its services, which are not actually being provided.

The firm said it appears it "will require the court's assistance" in order to get access to the site.
